Agreement
These Terms of Service ("Terms") are an agreement between you and BZOTech ("we", "us") about your use of the TempoGo mobile application and this website (together, "the Service"). If you do not agree, please do not use the Service. Our Privacy Policy explains how we handle data and is part of these Terms.
Who can use TempoGo
You must be at least 13 years old to use TempoGo. If you are under the age of majority where you live, you may only use the app with the permission of a parent or guardian.
Your license
We grant you a personal, non-exclusive, non-transferable, revocable license to download and use TempoGo on devices you own or control, for your own non-commercial use, in line with these Terms and the rules of the store you downloaded it from.
You may not copy, modify, distribute, sell or rent the app; reverse engineer or attempt to extract its source code, except where the law allows it; remove any proprietary notices; or use the Service in a way that is unlawful or that harms the Service or other people.
Health and safety
TempoGo is a timer, not medical advice. Interval training can be intense. Talk to a doctor before starting a new exercise program, especially if you have a medical condition, are pregnant, or have not exercised in a while. Stop immediately if you feel pain, dizziness or shortness of breath.
Ready-made routines and timers created by the AI builder are general suggestions and are not tailored to your health or fitness level. You are responsible for choosing workouts that are safe for you and for training in a safe environment. To the extent permitted by law, we are not responsible for any injury or health problem resulting from your use of the app.
AI timer builder
The AI timer builder turns your request into timer settings. It may misunderstand what you meant, so always review the timer before you confirm and start it. Do not include personal or sensitive information in your requests. The optional cloud AI feature is provided by a third party and may be changed, limited or removed at any time.
Ads and in-app purchases
TempoGo is free to download and is supported by ads. Where offered, you can buy Remove Ads, a one-time, non-consumable purchase that removes ads from the app on the store account you used to buy it. Purchases are processed by Google Play or the Apple App Store under their terms, including their refund policies. You can restore a purchase from the Remove Ads screen in Settings.
Prices are shown in the app before you buy and may vary by country.
Third-party services
The Service relies on third-party services such as Google Firebase, Google Drive, Google Gemini, Appodeal and the app stores. Your use of those services is also subject to their own terms and privacy policies. We are not responsible for third-party services or for content in ads served by ad partners.
Your content
Routines, names and settings you create belong to you. They are stored on your device, and optionally in your own Google Drive if you use backup. You are responsible for keeping your own backups; we cannot recover data that was deleted from your device.
Intellectual property
The app, its design, the TempoGo name and logo, and all related content are owned by BZOTech or its licensors and are protected by intellectual property laws. These Terms do not give you any right to use our trademarks.
Changes to the Service
We may update, change or discontinue features of the Service at any time, for example to improve it or to comply with the law or store policies. Some features may be available only in certain regions, versions or devices.
Disclaimer
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we make no warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the app will be error-free, uninterrupted, or that timer cues will always be delivered exactly on time on every device, as device settings such as battery optimization can affect background behavior.
Limitation of liability
To the fullest extent permitted by law, BZOTech will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of data, profits or goodwill, arising from your use of or inability to use the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the app in the 12 months before the claim, or USD 10 if you paid nothing. Nothing in these Terms limits liability that cannot be limited by law, and you may have additional rights under the consumer laws of your country.
Termination
You can stop using TempoGo at any time by uninstalling it. We may suspend or end your right to use the Service if you breach these Terms. Sections that by their nature should survive termination (such as intellectual property, disclaimers and limitation of liability) will continue to apply.
Additional terms for the App Store
If you downloaded TempoGo from the Apple App Store, you also agree that:
- These Terms are between you and BZOTech only, not Apple. BZOTech, not Apple, is solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation regarding the app.
- BZOTech, not Apple, is responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, and consumer protection claims.
- BZOTech, not Apple, is responsible for the investigation, defense, settlement and discharge of any third-party claim that the app infringes intellectual property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
Your use of the app must also comply with the Apple Media Services Terms and Conditions.
Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on this page and change the date at the top. If you keep using the Service after the changes take effect, you accept the updated Terms.
Governing law
These Terms are governed by the laws of the country where BZOTech is established, without regard to conflict-of-law rules, except where the mandatory consumer protection laws of your country of residence apply. If any provision of these Terms is found unenforceable, the remaining provisions remain in effect.
